General Terms and Conditions
Scope of application
These General Terms and Conditions govern the contractual relationship between KAIROS Partner AG and its customers. By placing an order and/or placing an order, the customer expressly accepts the terms and conditions and the current price list of KAIROS Partner AG as an integral part of the contract.
Terms and conditions of purchase and delivery
Our terms and conditions of purchase and delivery apply to all written, telephone and online orders and are accepted with every order.
All prices are quoted including or excluding the respective statutory VAT and excluding shipping costs (shipping, packaging, forwarding).
Special price promotions and customer discounts are only valid until further notice. Prices in CHF are valid at the time of ordering. Prices, colors and products are subject to change and errors excepted. KAIROS Partner AG does not charge a flat rate for small quantities. The prices for persolog products may be adjusted at any time due to inflation in Switzerland (reference: national consumer price index) or due to price developments at persolog GmbH.
Delivery information
KAIROS Partner AG generally delivers the ordered products within 5 working days of receipt of the order or repeat order. The customer reserves the right to give explicit instructions to the contrary. Postage costs of CHF 25 will be charged for express delivery at the customer's request. KAIROS Partner AG reserves the right to execute an order in partial deliveries if individual products are not in stock or not available from the manufacturer at short notice. Unforeseen events such as production stoppages on the part of the manufacturer, traffic disruptions or overloading of the Swiss Post may result in delays in delivery. In such cases, delivery or acceptance obligations shall be suspended to the extent and for the duration of the delay. Any claim for damages on the part of the customer is excluded. In the case of quantity purchases, KAIROS Partner AG reserves the right to agree the terms of delivery with the customer.
To avoid any misunderstandings, KAIROS Partner AG expressly recommends that orders and bookings for seminars, courses etc. be confirmed in writing. Otherwise you confirm that you accept the details of the order or booking from KAIROS Partner AG.
Purchase on account
You will receive a detailed invoice by e-mail with the delivered items. Transfer deadline: 20 days.
Down payment: In individual cases, we reserve the right to make the delivery of our goods dependent on a down payment.
Late payment: We are entitled to charge reminder fees up to a maximum of CHF 25. KAIROS Partner AG may refuse orders received without giving reasons in the event of late payment for earlier deliveries. Complaints about goods do not entitle the customer to withhold payment.
Purchase with credit card
At KAIROS Partner AG you can also pay by credit card. Simply select "Credit card" under payment method. KAIROS Partner AG is entitled to charge the actual transaction costs.
Retention of title
The products remain the property of KAIROS Partner AG until full payment has been made by the customer. KAIROS Partner AG is entitled to have its retention of title entered in the relevant retention of title register.
Transfer of risk, shipment, acceptance
When the goods are dispatched, the risk of accidental loss and accidental deterioration of the goods shall pass to the Buyer at the time of dispatch. Shipment shall be at the expense and risk of the buyer. The buyer must take out any insurance himself.
Seminar and course conditions
Course costs: Prices are quoted in Swiss francs. The course fee will be invoiced before the course begins. Unless otherwise stated, material fees will be charged in cash at the end of the course according to consumption.
Registration deadline: Please register early. Registrations will be considered in the order in which they are received. Your registration will be confirmed. A decision on whether the course will take place will be made at least 3 - 4 weeks before the start of the course. We keep a waiting list for fully booked courses.
Small groups: If there are fewer than 6 participants, there is no small group surcharge.
Cancellations after receipt of the definitive course confirmation will incur an administration fee of CHF 75. In addition, KAIROS Partner AG will charge the following partial amounts of the course fee:
d) full course fee thereafter.
Cancellations must be sent in writing to the KAIROS Partner AG back office.
If a confirmed in-house seminar or company-specific training course is canceled by the customer two weeks before the agreed date, 80% of the total costs shall be due for payment.
Eport 4.3
KAIROS Partner AG reserves the right to charge CHF 29.75 per 10 minutes for support requests for technical advice on eport 4.3 (or subsequent versions). By technical advice we mean everything that does not have to do with the initial configuration of your account or system services on our part.
Credit inventories are organized and managed by KAIROS Partner AG on behalf of persolog GmbH. Corresponding interventions for this purpose will be communicated in good time and are reserved.
Warranties
KAIROS Partner AG warrants that products are delivered in perfect condition. KAIROS Partner AG shall supply replacements for defective products or issue the customer with a corresponding credit note after consultation, unless the customer has not given notice of the defect in due time in accordance with the above provisions. Any further warranty, in particular for the properties and effects of the products, is excluded to the extent permitted by law. Any further product liability and warranty claims must be addressed to the manufacturers of the relevant products. The original invoice must be retained by the customer in order to assert any claims. Any warranty claims by the customer against KAIROS Partner AG shall lapse 3 months after delivery of the products, even if they have remained undiscovered until then. KAIROS Partner AG shall not be obliged to make a replacement delivery if it proves that it is not responsible for the defect complained of, in particular in the event of subsequent modification of the products by the customer or in the event of defective products or services of third parties for which the customer itself is responsible. Claims for damages due to any errors in the illustrations or in the prices and texts are excluded.
Intellectual property, copyrights, trademarks, image rights
The purchaser shall not reproduce, copy or publish the copyrighted works of KAIROS Partner AG / persolog Schweiz / persolog GmbH in any unauthorized form. The production of translations o derivations from KAIROS Partner AG / persolog Schweiz / persolog GmbH works is not permitted.
All image rights are held by KAIROS Partner AG or persolog GmbH. Use without express permission is not permitted.
General information
KAIROS Partner AG expressly reserves the right to amend these General Terms and Conditions at any time. By using the services of KAIROS Partner AG, the present General Terms and Condition shall be deemed to have been accepted without reservation. Any deviating terms and conditions of the customer shall not be binding on KAIROS Partner AG, subject to express written acceptance. Subsidiary agreements or further commitments by KAIROS Partner AG must be made in writing.
Final provisions
The registered office of KAIROS Partner AG shall be the exclusive place of jurisdiction.
